1Acceptance of terms

By downloading, installing or using Gout-Cha! (the "App"), you agree to be bound by these Terms of Use (the "Terms"). If you do not accept these Terms, do not use the App.

2Service description

Gout-Cha! is a health tracking app designed to help manage gout by:

• Tracking food intake and purine content
• Logging gout flare episodes
• Monitoring hydration levels
• Providing AI-assisted dietary recommendations
• Generating health statistics and medical reports

3Eligibility

• You must be at least 18 years old to use this App
• You must provide accurate and complete registration information
• You are responsible for keeping your credentials confidential
• You agree to notify us immediately of any unauthorized access to your account

4Subscriptions and payments

4.1 Premium subscription

Gout-Cha! offers a Premium subscription with access to advanced features:

• Unlimited conversations with the AI assistant
• Advanced statistics and trend analysis
• Medical export for doctors
• Priority support

4.2 Pricing and billing

• Monthly subscription: €9.99/month
• Annual subscription: €59.99/year (save 50%)
• Prices may vary by country and are subject to applicable taxes
• Prices are shown in the App before purchase

4.3 Auto-renewal

• Subscriptions renew automatically unless auto-renewal is turned off at least 24 h before the end of the current period
• Your account will be charged within 24 h before the end of the current period
• You can manage your subscriptions in your device Settings after purchase
• No cancellation of the active period is allowed during that period
• Any unused portion of a free trial is forfeited upon purchasing a subscription

4.4 How to cancel

iOS: Settings → your name → Subscriptions → Gout-Cha! → Cancel subscription.
Android: Google Play → profile → Payments & subscriptions → Subscriptions → Gout-Cha! → Cancel subscription.

4.5 Free trial

New users may be offered a 7-day free trial, with no charge during the trial. If you do not cancel at least 24 h before it ends, you will be automatically charged for the subscription.

4.6 Refund policy

Refunds are handled by Apple's App Store or the Google Play Store under their respective policies. We do not have access to direct refund processing; please contact Apple or Google support.

5User responsibilities

You agree to:

• Provide accurate health information
• Use the App for personal, non-commercial purposes only
• Not share your account credentials
• Not attempt to decompile, disassemble or hack the App
• Not use the App for illegal or unauthorized purposes
• Comply with all applicable laws

6Medical disclaimer

• Gout-Cha! is a wellness and tracking tool, not a medical device
• The App does not diagnose, treat, cure or prevent any disease
• AI recommendations are for informational purposes only and do not replace professional medical advice
• Always consult a qualified healthcare professional before any health-related decision
• In a medical emergency (severe flare, fever > 38.5 °C / 101.3 °F), seek immediate medical care
• Do not use the App as a substitute for professional medical care

7Intellectual property

All content and features of the App (text, graphics, logos, icons, images, audio clips and software) are the exclusive property of Gout-Cha! or its licensors, protected by intellectual property laws.

Your data: you retain all rights to the health data you enter. By using the App, you grant us a limited license to use, store and process your data solely to provide the App's services.

8Limitation of liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We do not warrant that the App will be error-free, uninterrupted or secure
• We are not liable for health consequences resulting from use or misuse of the App
• We are not liable for indirect, incidental, special or consequential damages
• Our total liability will not exceed the amount you paid for the subscription in the last 12 months

9Data and privacy

Your use of the App is also governed by our Privacy Policy, incorporated into these Terms by reference. Please review it to understand how we collect, use and protect your personal health data.

10Termination

10.1 By you

• By cancelling your subscription (see Section 4.4)
• By deleting your account via the Delete account page
• By uninstalling the App

10.2 By us

We reserve the right to suspend or terminate your account if you breach these Terms, including fraudulent activity, misuse of the App or unlawful conduct.

11Changes to the terms

We may update these Terms from time to time. Significant changes will be notified by email or in-app notification. Your continued use after changes constitutes acceptance of the new Terms.

12Governing law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-law provisions. Any dispute will be resolved before the courts of Paris, France.

13Third-party services

The App integrates with third-party services:

• Anthropic (Claude) : powers the AI assistant (subject to Anthropic's terms)
• Supabase: provides secure data storage (subject to Supabase's terms)
• Apple App Store / Google Play Store: handle subscription payments

We are not responsible for the practices or content of these third-party services.
