3. User Eligibility

You must be at least 18 years old to use this App

You agree to notify us immediately of any unauthorized access to your account

4. Subscriptions and Payments

4.1 Premium Subscription

Ça Goutte! offers a Premium subscription with access to advanced features:

Unlimited AI assistant conversations
Advanced statistics and trend analysis
Medical CSV export for doctors
Priority support

4.2 Pricing and Billing

Monthly Subscription: €4.99/month
Annual Subscription: €49.99/year (save 17%)
Prices may vary by country and are subject to applicable taxes
Prices are displayed in the App before purchase

4.3 Auto-Renewable Subscriptions

Important Information About Subscriptions:

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage your subscriptions and turn off auto-renewal in your device's Account Settings after purchase
No cancellation of the current subscription is allowed during the active subscription period
Any unused portion of a free trial period will be forfeited when you purchase a subscription

4.4 How to Cancel Your Subscription

For iOS users:

Open the Settings app on your iPhone or iPad
Tap your name at the top
Tap "Subscriptions"
Select "Ça Goutte!"
Tap "Cancel Subscription"

For Android users:

Open the Google Play Store app
Tap your profile icon → "Payments & subscriptions" → "Subscriptions"
Select "Ça Goutte!"
Tap "Cancel subscription"

4.5 Free Trial

New users may be offered a 7-day free trial. You will not be charged during the trial period. If you do not cancel at least 24 hours before the trial ends, you will be automatically charged for the subscription.

4.6 Refund Policy

Refunds are handled by Apple App Store or Google Play Store according to their respective policies. We do not have access to process refunds directly. To request a refund, please contact Apple or Google support.

5. User Responsibilities

You agree to:

Provide accurate health information
Use the App for personal, non-commercial purposes only
Not share your account credentials with others
Not attempt to reverse engineer, decompile, or hack the App
Not use the App for any illegal or unauthorized purpose
Comply with all applicable local, state, national, and international laws

6. Medical Disclaimer

The App does NOT diagnose, treat, cure, or prevent any disease
AI recommendations are for informational purposes only and should NOT replace professional medical advice

In case of medical emergency (severe crisis, fever >38.5°C), seek immediate medical attention
Do NOT use the App as a substitute for professional medical care

7. Intellectual Property

All content, features, and functionality of the App (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are the exclusive property of Ça Goutte! or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

Your Data: You retain all rights to the health data you input into the App. By using the App, you grant us a limited license to use, store, and process your data solely to provide the App's services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
We do not guarantee that the App will be error-free, uninterrupted, or secure
We are not liable for any health consequences resulting from use or misuse of the App
We are not responsible for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid for the subscription in the past 12 months

9. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal health data.

10. Termination

10.1 By You

You may terminate your account at any time by:

Canceling your subscription (see Section 4.4)
Deleting your account via https://cagoutte.app/delete
Uninstalling the App

10.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, including but not limited to fraudulent activity, misuse of the App, or illegal conduct.

11. Changes to Terms

We may update these Terms from time to time. Significant changes will be notified via email or in-app notification. Your continued use of the App after changes are made constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Paris, France.

The App integrates with third-party services:

OpenAI: Powers the AI assistant (subject to OpenAI's terms)
